AIR CONTROL TERMS & CONDITIONS

Terms and Conditions Teacher Training (Self directed and Live)

Please read and agree to our terms & conditions before starting the course.

1. Definitions
a. “Air Control Pilates” means Air Control Pilates Limited, Company number SC530057 having its registered office at The Grain Loft, Bowhouse, Saint Monans, Fife, Scotland UK KY10 3FA, UK,  Contact Telephone Number:  + 44 7957 679334 
b. “Contract” means the contract between Air Control PilatesⓇ Ltd and the Customer for the supply of Services in accordance with these Terms and Conditions.
c. “Customer” (including references to You and Your) means the person or firm who purchases the Services from Air Control PilatesⓇ Ltd.
d. “Learner” (including references to You and Your) means the person or firm who purchases the Services from Air Control PilatesⓇ Ltd.  
e. “Services” means the services provided in relation to the Aerial Pilates teacher training course supplied by Air Control PilatesⓇ Ltd to the Customer.
 
2. Booking
Air Control PilatesⓇ Ltd. must receive all application forms and complete enrolment no less than one week before the course start date. Booking is only confirmed once a full course fee is received or payment plan is agreed and initiated via our online platform.
 
3. Certificate
Upon successful completion of this Aerial Pilates teacher training course you will receive an Air Control PilatesⓇ certificate with the Active IQ Professional Recognition stamp of approval.
 
4. Ownership 

The Customer acknowledges that Air Control PilatesⓇ owns all rights, title and interest (including intellectual property rights).  By signing the customer agrees to never distribute downloadable educational content. Downloadable educational content includes:

a. Worksheets
b. Lesson Plans
c. Videos, photos and images.
d. Content and Intellectual Property

Sharing and distributing the Air Control Pilates® educational materials will be considered an intellectual property infringement, and will result in immediate termination of your licence and may incur a penalty fee of up to £10,000.

5. Price of courses
All course prices are correct at the time of publishing. Air Control PilatesⓇ Ltd. reserves the right to change these prices at any given time.
 
6. Cancellations
Cancellations are at the following rates:
a. No refunds available for online modules, online subscriptions, Aerial Pilates teacher training, online, in-person or self-directed.
b. For the Live and Online Aerial Pilates Teacher Training, 60 days before course start date: 50% refund of course fees paid minus £50 admin fee.
 
7. License Agreement
A License to use the Air Control PilatesⓇ logo and branding can be purchased through our online platform at additional cost.
 
8. Transfers
Transfer to another course may be possible, however this is at the discretion of Air Control PilatesⓇ Ltd. If you would like to request a course transfer please contact Air Control PilatesⓇ Ltd.at the earliest opportunity. Transfers may not be able to be accommodated at short notice.
 
9. Refunds
Refunds are at the discretion of Air Control PilatesⓇ Ltd. If you would like to cancel your place, please see point 6. If courses are cancelled by Air Control PilatesⓇ full refunds will be given or the option to transfer to another course date.
 
10. Feedback and complaints
Please send all comments, complaints or issues in writing to info@aircontrolpilates.com. These emails will be answered within 7 days.
 
11. Limited Liability:

YOUR ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE

a. Nothing in the Contract shall limit or exclude the Air Control PilatesⓇ Ltd.’s liability for:
i. death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
ii. fraud or fraudulent misrepresentation; or
iii. breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law.
b. Subject to clause 11.a  above, Air Control PilatesⓇ Limited shall not be liable to You, whether in contract, delict (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
i. damage to equipment;
ii. loss of profits;
iii. loss of sales or business;
iv. loss of agreements or contracts;
v. loss of anticipated savings;
vi. loss of use or corruption of software, data or information;
vii. loss of damage to goodwill; and
viii. any indirect or consequential loss
ix. subject to clause 11.a, death or personal injury from any use of the course content and written material relating to the Contract used outside of the Services.
c. Subject to clause 11.a, Air Control PilatesⓇ Limited total liability to You, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to 100% of the total sums paid under the Contract.
d. The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Contract.
e. This clause 11 shall survive termination of the Contract.
12. General
Air Control PilatesⓇ Ltd. and the Customer are not in partnership with each other, nor are they agents of each other.

 

I have read, understand and agree with these terms and conditions. I accept this policy as it relates to teacher training with Air Control PilatesⓇ

I have been informed, understand and am aware that strength, flexibility, mental and aerobic exercises, including the use of equipment to do aerial exercises, are potential hazardous activities. I am voluntarily participating in these activities and using equipment with full knowledge, understanding and appreciation of the danger involved.

I have made myself aware of legal requirements and regulations that may apply in my country in regards to these activities, I hereby agree to expressly assume and accept any and all risks of injury, and release Air Control PilatesⓇ Ltd., its agents, officers and employees from any liability with respect to these risks while participating in this class, workshop or teacher training.
