- “Contract” means the contract between Air Control Pilates Ltd and the Customer for the supply of Services in accordance with these Terms and Conditions.
- “Customer” (including references to You and Your) means the person or firm who purchases the Services from Air Control Pilates Ltd.
- “Services” means the services provided in relation to the Aerial Pilates teacher training course supplied by Air Control Pilates Ltd to the Customer.
Air Control Pilates must receive all registration forms no less than one week before the course start date. Booking is only confirmed once a deposit of £250 or full course fee is received.
The pre-requisite to this course is a Level 3 Mat Pilates qualification or equivalent. Copies of your certificate(s) must be sent to Air Control Pilates along with your booking form.
Upon successful completion of this Aerial Pilates teacher-training course you will receive an Air Control Pilates certificate with the Active IQ Professional Recognition stamp of approval.
4. Price of courses
All course prices are correct at the time of publishing. Air Control Pilates reserve the right to change these prices at any given time.
A £50 discount is available if your course fee is paid in full no less than two weeks before the course start date. One free course place is available in exchange for hire of a studio space for the duration of the course, this is by prior agreement only. Only one discount is applicable per booking.
6. Provisional bookings
Provisional bookings can be made however a deposit must be received no less than two weeks before the course start date otherwise you may lose your place.
Cancellations are at the following rates:
2 weeks or less before course start date: no refund.
15 or more days before course start date: 50% refund of course fees paid minus £50 admin fee.
8. How to pay

- License Agreement
Use of the logo is strictly for individual use only and for use for Air Control Aerial Pilates classes and workshops only. Investment is £10 a month or £99 per year for individual use and £350 for venue use for up to 5 ‘Air Control Pilates’ instructors.

Transfer to another course may be possible, however this is at the discretion of Air Control Pilates. If you would like to request a course transfer please contact Air Control Pilates at the earliest opportunity. Transfers can be made a maximum of twice.
Any substitutions are at the discretion of Air Control Pilates and requests for this must be no less than 48 hours before the course starts.
Refunds are at the discretion of Air Control Pilates. If you would like to cancel your place, please see point 6. If courses are cancelled by Air Control Pilates full refunds will be given or the option to transfer to another course date. You have the right to cancel within 7 days of your contract, which is a cooling off period.

- Limited Liability:
YOUR ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE
15.1. Nothing in the Contract shall limit or exclude the Air Control Pilates Ltd’s liability for:
15.1.1. death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
15.1.2. fraud or fraudulent misrepresentation; or
15.1.3. breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession) or any other liability which cannot be limited or excluded by applicable law.
15.2. Subject to clause 15.1, Air Control Pilates Limited shall not be liable to You, whether in contract, delict (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
15.2.1. damage to equipment;
15.2.2. loss of profits;
15.2.3. loss of sales or business;
15.2.4. loss of agreements or contracts;
15.2.5. loss of anticipated savings;
15.2.6. loss of use or corruption of software, data or information;
15.2.7. loss of damage to goodwill; and
15.2.8. any indirect or consequential loss
15.2.9 subject to clause 15.1, death or personal injury from any use of the course content and written material relating to the Contract used outside of the Services. Responsibility lies with the instructor delivering the class.
15.3. Subject to clause 15.1, Air Control Pilates Limited total liability to You, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to 100% of the total sums paid under the Contract.
15.4. The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Contract.
15.5. This clause 15 shall survive termination of the Contract.
- Air Control Pilates and the Customer are not in partnership with each other, nor are they agents of each other.
